Terms of Service

By installing the StellarCaptions Chrome extension or creating an account on our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

These Terms constitute the entire agreement between you and StellarCaptions regarding your use of the service.

StellarCaptions provides a Chrome browser extension that generates real-time captions, translations, and AI-dubbed audio for audio content played through your browser or captured from your computer. The service is provided on a credits-based model.

You must be at least 13 years of age to use StellarCaptions. By using the service, you represent that you meet this requirement. Users between 13 and 18 must have parental or guardian consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@stellarcaptions.com if you suspect unauthorized access to your account.

You may not share your account with others or create multiple accounts to circumvent credit limits or restrictions.

• New accounts receive 70 free credits with no credit card required.
• Additional credits and subscription plans are available for purchase through Stripe.
• Credits are non-refundable once consumed. Unused credits on paid plans may be refunded within 7 days of purchase, subject to review.
• Credits have no monetary value and cannot be transferred between accounts.
• We reserve the right to modify pricing and credit amounts at any time, with notice to existing subscribers.
• Subscriptions renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period.

You agree to use StellarCaptions only for lawful purposes and in a manner that does not infringe on the rights of others. The following are strictly prohibited:

• Using the service to transcribe, translate, or dub content that is illegal in your jurisdiction or in Canada
• Using the service to process or distribute NSFW (not safe for work) content
• Attempting to reverse-engineer, decompile, or circumvent any part of the service
• Reselling or sublicensing access to the service without written authorization
• Automating access in a way that places unreasonable load on our infrastructure
• Using the service to violate the intellectual property rights of content creators or rights holders
• Creating accounts fraudulently to exploit free credit allocations

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice, at our sole discretion.

StellarCaptions processes audio that you choose to capture. You are solely responsible for ensuring you have the right to capture, transcribe, and translate that audio. We are not responsible for any copyright infringement or legal liability arising from your use of the service on third-party content.

We do not store or claim ownership of any audio or transcripts you generate. Your transcripts belong to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CAPTIONS AND TRANSLATIONS WILL BE ACCURATE. TRANSCRIPTION AND TRANSLATION ERRORS ARE INHERENT TO AUTOMATED SPEECH PROCESSING.

WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, STELLARCAPTIONS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) CAD $50.

You agree to indemnify, defend, and hold harmless StellarCaptions and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Ontario, Canada, in accordance with applicable arbitration rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on our website at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the service and may request account deletion.

You may delete your account at any time from the Account page. We may suspend or terminate your access at any time for violations of these Terms or for any other reason at our discretion, with or without prior notice.

Upon termination, your right to use the service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.
